    The international legal principle of ‘no-harm’, as a customary international law, lies at the heart of numerous international transboundary water conventions, rules, and agreements. The current study identifies and examines the three most common categories of harm, namely health, environmental, and economic, in an integrated framework.     Hamoon international wetlands, as entities which have their own subjective right from nature and natural resources possess social, economical, cultural, protective, and ecological values. As the common heritage of mankind and according to the rules of international environmental customary law, these wetlands have an undeniable right from the Helmand River Basin water resources. Due to the various values of Hamoon wetlands in general, and their intrinsic importance in particular, this paper tries to interpret the 1973 Helmand Treaty in order to find out what is the Hamoon's wetlands water right in the 1973 treaty.     Abstract

    The examination of water interactions history between Iran and Afghanistan over the Hirmand River and the illustration of these relations using the Transboundary Waters Interaction Nexus (TWINS) matrix show that water sharing in the Hirmand River basin, in addition to climatical situations, is highly affected by political, economic, and social relations and interactions between two riparian countries. It shows that in most periods, the Hirmand water apportionment conflicts have been policizited; but during 2010-2020 it has been opportunitized because of the Westernization tendency and Anti-Iranian sentiment procedure in Afghanistan which shaped by Anti-Iranian media.     Despite signing a bilateral water treaty in 1973, water utilization in the Hirmand River Basin (HRB) has been a source of dispute between Iran and Afghanistan for many decades. While Iran accuses Afghanistan of depriving it of the Hirmand water due to dam construction in the upper basin, Afghanistan assures that it enforces the treaty. An evident reduction of the Hirmand River flow to Iran in recent years is fully attributed by Afghanistan to a reduction in precipitation in the basin.
